The complainant in this matter is a paralegal who represented an individual who appeared before the Immigration and Refugee Board of Canada's (IRB) Refugee Protection Division (RPD). The complaint was submitted to the IRB Office of Integrity's generic email address. The complaint was considered by the Office Integrity under the Procedures for Making a Complaint about a Member (the Procedures).
The essence of the complaint was that the complainant felt humiliated by the member, and the member insulted the complainant.
The investigation found that the complainant's carriage of her client's file up to the date of the hearing, was seriously lacking. The member made the claimant aware of the shortcomings of his case and adjourned the matter to a later date in order that new counsel of record might rectify those shortcomings. The member handled this difficult hearing in a tactful, objective and professional manner. It was determined that there was no breach of the Code of Conduct on the part of the member.
