The Refugee Appeal Division (RAD) has issued a practice notice stating that it will now schedule virtual hearings for all appeals that require a hearing.
This approach, which took effect November 2, 2020, will ensure continued access to justice while continuing to protect the health and safety of all participants.
Counsel for the appellant will be asked to confirm their availability for the proposed hearing date and can request an in-person hearing if they have specific concerns with holding the hearing virtually. The RAD will consider these requests on a case-by-case basis.
