Practice Notice on Resumption of Time Limits at the Immigration Appeal Division (IAD)

​This Immigration Appeal Division (IAD) Practice Notice is to advise that the temporary extension of time limits for filing a Notice of Appeal and for providing requested documents will end on August 4, 2020. Effective August 5, 2020, all parties are required to comply with all regular time limits as set out in the IAD rules.

The IAD’s resumption of time limits follows the issuance of the Resumption Notice on June 19, 2020.  Thus, the previous temporary extension of time limits the IAD provided for in the Practice Notice on the temporary extension of time limits for filing a Notice of Appeal and the Practice Notice regarding Special Measures due to COVID-19 have been modified as outlined below.

Notice of Appeal

As a result of the Resumption Notice, the temporary extension of time limits for filing a Notice of Appeal is extended beyond the 30 days previously provided and will end on August 4, 2020. This means where the time limits for filing a Notice of Appeal fall between March 16, 2020 and August 4, 2020 inclusively, it must be filed no later than August 4, 2020.

Effective August 5, 2020, the IAD will reinstate regular time limits for filing a Notice of Appeal.

Providing Documents

The extension of time limits for providing documents requested by the IAD is extended beyond the 30 days previously provided and will end on August 4, 2020. This means where the time limits for providing documents fall between March 16, 2020 and August 4, 2020, inclusively, they must be filed no later than August 4, 2020. However, disclosure for a hearing must still be received by the IAD no later than 20 days before the scheduled hearing date. In addition, disclosure for Alternative Dispute Resolution (ADR) must still be received by the IAD no later than 10 days before the ADR conference.

Effective August 5, 2020, all parties must comply with all time limits as set in the IAD Rules.
